Top 5 Reasons Homebuyers File RERA Complaints and How to Avoid Them

The Role of Risk Management in Wealth Preservation and Growth
If you’ve been served a RERA complaint, you already know how disruptive it can be a stalled sale, a public-facing dispute, and time spent in tribunal that could have gone into your next project. Most complaints, however, trace back to a handful of recurring, preventable issues. Here’s what we see most often, and how to close the gap before it becomes a filing.
1. Possession Delays Without Communication
The single largest driver of RERA complaints isn’t delay itself, buyers understand construction timelines slip. It’s silence. When promoters don’t proactively communicate revised timelines, homebuyers assume the worst and head straight to the tribunal.
Fix: Issue written, dated communication the moment a timeline shifts, even by a few months. A paper trail showing proactive disclosure is also your strongest defence if a complaint is filed anyway.
2. Mismatch Between Sale Brochure and Final Delivery
Complaints frequently arise from differences between what was marketed (amenities, carpet area, specifications) and what’s actually delivered. Under RERA, promotional material can be treated as part of the contractual promise.
Fix: Ensure your brochure, agreement, and as-built specifications are reconciled before marketing begins. Any change post-launch should be formally communicated and, where required, consented to by allottees.
3. Escrow Account Irregularities
Buyers and their lawyers increasingly ask for escrow account details before escalating. Any indication that project funds were diverted, even temporarily, tends to trigger a complaint rather than a query.
Fix: Maintain strict Section 4(2)(l)(D) compliance and be prepared to demonstrate it. We’ll cover this in detail in a future issue.
4. Ambiguous or Non-Standard Agreement Clauses
Builder-buyer agreements drafted years ago, or copied from non-RERA-compliant templates, often contain clauses that don’t hold up particularly around penalty interest, force majeure, and cancellation terms. Ambiguity gets read against the drafter.
Fix: Have existing templates reviewed against current RERA and case law standards, not just at project launch but periodically as precedent develops.
5. Poor Response to Buyer Grievances Pre-Litigation
Many complaints are filed not because the underlying issue was unreasonable, but because the buyer’s initial grievance went unanswered or was handled informally, with no documentation of resolution attempts.
Fix: Set up a simple internal process to log and respond to buyer complaints in writing, even for minor issues. Tribunals notice a documented good-faith effort to resolve matters before litigation was invoked.
